Real Estate

Olson & Associates’ real estate practice encompasses all aspects of real estate ownership, development and transfer – from the most straightforward residential purchase to the most complex commercial transaction involving layered ownership and multiple sources of financing. Our attorneys are familiar with all Vermont real estate title issues, as well as all Vermont permit and regulatory issues at both the State and local levels. We represent both buyers and sellers of real estate in Vermont and assist clients through the ever increasing complexity of buying and selling property. Our services include, among others:

  1. Drafting and negotiation of purchase and sale agreements, deeds, leases, mortgages, promissory notes and other security instruments;
  2. Formation of corporations and limited liability companies for the purpose of acquiring, developing and managing real estate;
  3. Title services including title searches, title opinions and title insurance offered through our agency for Vermont Attorneys Title Corporation;
  4. Closing attorney services including review of deeds and required transfer documents, review and explanation of settlement statements, mortgages and closing documents provided by lenders and third parties involved in the transaction;
  5. Supervision of closing services, including oversight of the execution of all documents, disbursement of funds, wire transferring of mortgage and other payoffs, and delivery of documents for recording in the appropriate town or city land records.

Estate Planning

Planning an estate is a very individual and personal matter. It involves the whole of a person’s life, including their family relationships, their business plans, their assets, their hopes and dreams and their goals for the future. The discussion that is necessary to the formation of an estate plan is one that is often difficult to have as it focuses on issues that remind us of our mortality. Therefore, an estate planning attorney must not only possess extensive knowledge of the applicable laws and the ability to prepare well-drafted, technically correct, thorough, and clear legal documents. He or she must also have the ability to listen carefully to a client; to hear the client’s concerns; to help, when necessary, to clarify goals and objectives, such as how to take care of a disabled child without affecting government benefits, how to plan for the possibility of long term care needs, or how to pass on the family business. Our goal, in handling the matters of our clients, is to do just that. Listen. And then prepare documents that accurately reflect our clients’ wishes.

Estate Administration

Administering an estate can take various forms. Among these are probate proceedings (where the decedent dies with a will), administration proceedings (where the decedent dies without a will) and the distribution of assets from a revocable or living trust. Regardless of the type of administration that is required in a particular case the overall goal is the same; that is, to collect the assets the decedent owned, to determine and pay appropriate bills, to determine what estate and/or income tax returns are required to be filed and what taxes are to be paid, to prepare an accounting and to distribute the assets to the beneficiaries. We have the detailed knowledge and experience necessary to conduct this work in an efficient, orderly, conscientious and correct manner.
